The agreement
These terms are a legally binding agreement between you and nevertoss.com ("we", "us"). By accessing or using nevertoss.com, you agree to be bound by them. If you don't agree, don't use the site. You need to be at least 13 to use it.
What the service is right now
Today, nevertoss.com is a marketing site with guides, comparisons and an email waitlist for the NeverToss iOS app, which is rolling out in early access. Features may change as the app evolves, and early access may be limited, paused or reshaped while we scale it. A legacy web app exists behind sign-in; we're retiring it and it may change or disappear without notice.
Dates and food safety
This one matters. Shelf-life windows in NeverToss are estimates inferred by AI. They are not manufacturer best-before dates, and receipts and barcodes don't carry real ones. Our storage guides summarize published USDA and FoodSafety.gov guidance, but nothing on this site is food-safety, health or professional advice. Whether food is safe to eat is always your call. When in doubt, throw it out.
Using the site
Don't abuse it: no scraping the waitlist, no submitting other people's email addresses, no attacking or overloading the service, no using the site to break the law. We can suspend or close accounts and remove content to protect the service.
Your content
Receipts and data you upload stay yours. You give us the permission needed to store and process them to run the service (including the AI processing described in the privacy policy), and nothing more. Everything else on the site — copy, design, guides, the NeverToss name and mark — belongs to us. © nevertoss.com.
No warranty, limited liability
The site and service are provided "as is", without warranties of any kind, to the fullest extent the law allows. We're not liable for indirect, incidental or consequential damages, including spoiled food, tossed food, or reliance on an estimated date. Where liability can't be excluded, it's capped at $50 or the amount you paid us in the past 12 months, whichever is greater. Some places don't allow these limits, so parts of this may not apply to you.
Governing law
These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Disputes go to the courts located there.
Changes
We may update these terms as the product evolves. The date at the top always reflects the current version, and continuing to use the site after a change means you accept it.
